On 9/9/08, a resident with dementia choked on two separate occasions and died due to neglect. Due to a swallowing disorder, the resident's doctor ordered a pureed diet. On the evening of his death, a nursing assistant administered the Heimlich maneuver and the resident coughed up "tomato-like" material after being fed the wrong diet. Later that evening, the resident reportedly grabbed a sandwich from a food cart and began to eat it. He started choking, turned colors and died within an hour. The facility initially claimed he died of a heart attack, and did not report he choked on the sandwich until three months later, after an autopsy report showed he died of asphyxiation caused by a "mass of yellow-white pasty material." Furthermore, after the resident was found unresponsive, the facility staff failed to assess him for possible aspiration and failed to provide immediate emergency treatment.
