Joseph L., age 70, had dementia and was living in a skilled care facility as he recovered from hip surgery. His son, David, found medication and an NG tube that were being administered to his father both had expired "use-by" dates on them. Further, his father’s pain was not being effectively addressed.

One day, David discovered that his father's hip had been broken again; he also had a black eye and bruising. Soon after, he found his father was malnourished and suffering from decubitus ulcers. David brought formal complaints against the facility, and an out-of-court settlement was ultimately reached.
