Jessie S., age 86, was living in a skilled nursing home in San Diego County. She had had a stroke, and suffered from dementia. It was agreed that she was to have assistance with all transfers, yet she had three separate falls. The last occurred when she was left on the toilet unattended: she cut her head badly and broke her hip in three places.

In spite of the severity of her injuries, staff wouldn't call for emergency transportation for some 12 hours, insisting that they had to have a doctor's orders to authorize the transfer. Her daughter sought and won an out-of-court settlement for negligence.
