This course will include recent legislative and regulatory changes; the impact of the Affordable Care Act Implementation in California on seniors and persons with disabilities; the use of care contracts in long term care planning; rights and remedies pertaining to long term care insurance; and a “review” of frequently asked questions regarding Medi-Cal, Medicare and Long Term Care.

Who Should Attend

These sessions are designed for legal services staff, private bar attorneys and other advocates interested in emerging issues in long- term care, with an emphasis on Medi-Cal and long term care. Please note – these sessions assume some prior knowledge and experience with Medi-Cal, long term care and/or estate planning issues.

Faculty

Faculty members, all recognized experts in the areas of Estate Planning, Medi-Cal and Planning for Long Term Care, include Alan Kassan, Esq. and Corrine Chandler of Kantor & Kantor, LLP; Dallas Atkins, Esq., Amber Cutler, Esq., NSCLC, and Patricia L. McGinnis, ED, CANHR.

Tuition

$225 for private bar attorneys and other estate planning professionals.
Tuition includes materials, continental breakfast and lunch.

Registration Deadline

Registration and fees received one week prior to the training (May 3) will qualify for mail-back registration confirmation.

Refund Policy

All cancellations must be received by CANHR in writing at least 5 business days prior to the training – May 5, 2014. Refunds will be subject to a $50 handling fee. Cancellations received after that date will not be eligible for a refund. No refunds will be given to those who register but do not attend the training.

Agenda

  1. Introduction & Updates
    Review of recent legislation and regulations that will impact long term care and estate planning issues.
  2. Long Term Care Insurance Issues and Remedies
    This session will discuss long term care insurance disputes with a focus on the remedies available for denial of claims.
  3. Using Care Contracts in Medi-Cal Planning
    This session reviews the whys and hows of using of care contracts in Medi-Cal planning, including practice tips for preparing care contracts in California, and sample provisions.
  4. Implementation of ACA: Impact on SPDs (Seniors and Persons with Disabilities)
    This session will explore the major changes in health care services to low income seniors and persons with disabilities including Covered California, the Coordinated Care Initiative, expansion of Medi-Cal benefits under ACA and Long Term Care Services and Supports, and the integration of these programs overall with Medi-Cal eligibility rules and regulations.
  5. Frequently Asked Questions about Medi-Cal and Long Term Care*
    Qs & As on LGBT and Medi-Cal planning, Medicare “improvement” standard and the Jimmo case, spousal impoverishment, ethical issues, Medi-Cal practice tips, and dealing with LTC issues.(This session will include .5 hours of MCLE ethics credits)

Time

Registration is from 8:00 to 9:00 am. All programs will run from 9:00 am to 5:00 pm. Complimentary continental breakfast served from 8:00 to 9:00 am. Lunch served on the premises from 12:00 to 1:00 pm.

MCLE and Legal Specialization Credits

MCLE Credits: These activities have been approved for MCLE credit by the State Bar of California in the amount of 6.5 hours, of which 0.5 hours will apply to legal ethics. Paralegal Credits: These activities also qualify for paralegal CEU. CANHR is a State Bar approved MCLE provider.

Legal Specialization: This program qualifies for Legal Specialization credits in the field of Estate Planning, Trust and Probate Law.
